Seller agreement
This agreement is made between Mizad Iraq for Electronic Auctions and the user who offers an asset for sale (the "Seller"), and is accepted electronically before the first listing is published.
1. تفويض البيع
- يفوض البائع المنصة بعرض الأصل في مزاد علني إلكتروني وفق الشروط المتفق عليها في الإعلان (السعر الافتتاحي، السعر الاحتياطي، مدة المزاد، الشراء الفوري).
- يقر البائع بأنه المالك الشرعي أو المفوض قانونا، ويقدم ما يثبت ذلك (السنوية، السند العقاري، الوكالة، قرار الشركة).
2. وصف الأصل
- يلتزم البائع بوصف صادق وكامل يشمل العيوب الجوهرية والحوادث والأعطال المعروفة وعدد المفاتيح وحالة السند.
- يحق للمنصة فحص الأصل وإصدار تقرير فحص معتمد، وتعديل التصنيف أو العنوان لتحقيق الدقة، ورفض الإعلان المضلل.
- يتحمل البائع المسؤولية القانونية عن أي إخفاء متعمد لعيب جوهري.
3. الإيداع في الساحة
When an asset is deposited at the platform's yards it is recorded with a receipt report, photos and a stock number, and the platform is responsible for keeping it with ordinary care until it is delivered to the buyer or returned to the seller.
4. الضمان والسعر الاحتياطي
- قد يُشترط على البائع ضمان مالي يُصادر جزئيا فقط بقرار نهائي إذا امتنع عن التسليم أو ثبت تضليل جوهري.
- السعر الاحتياطي سري ولا يُباع الأصل دونه، ولا يجوز للبائع رفعه بعد بدء المزاد.
5. العمولة والتسوية
- تُستوفى عمولة البائع المعلنة من ثمن البيع، وتظهر بندا مستقلا في كشف الحساب المختوم.
- يُحوّل صافي المستحق إلى حساب البائع المصرفي أو محفظته بعد اكتمال الدفع والتسليم وانتهاء فترة الاعتراض، عبر طلب صرف يعتمده موظفون مستقلون وتُسجل مرجعيته لدى مزود الدفع.
6. الامتناعات
The seller may not: bid on their own asset directly or through others, withdraw the asset after the auction starts without an acceptable reason, deal with buyers outside the platform, or sell the asset to another party while it is listed. Violations expose the seller to guarantee forfeiture, compensation and account termination.
7. نقل الملكية
The seller must attend, or appoint an agent, to complete the ownership transfer at the traffic directorate or Real Estate Registration Department, provide the original documents, and bear the fines and charges on the asset up to the delivery date.
8. أحكام عامة
تسري على هذه الاتفاقية Terms & conditions andRights & obligations of the parties والقانون العراقي النافذ.
